São Paulo – Registration is open for a talk on arbitrage due at the Arab Brazilian Chamber of Commerce<\/strong>, in São Paulo, Câmara de Comércio Árabe Brasileira, on September 17th. The attorney Flávio Pereira Lima, a partner at the disputes and arbitration practice at law firm Mattos Filho Advogados, and the chairman of the Mediation, Conciliation and Arbitration Chamber of the Order of Attorneys of Brazil (OAB) in São Paulo, will speak on the matter. Attendance is free of charge. <\/p>\n Lima will explain what arbitration is, how it works, what are its advantages and disadvantages, and he will recount, for the sake of comparison, cases of lawsuits which dragged on for a long time, as well as instances where arbitration worked out, and others where it did not. Arbitration is a sort of private justice. “Instead of taking a dispute to court, the parties enter an agreement to settle the issue privately,” says the attorney. <\/p>\n In traditional arbitration, each party picks an arbiter, usually an attorney, and the latter two then choose a third arbiter. Arbitration can be selected as early as the signing of the contract between the parties, or later on. The idea is for the process to be faster than ordinary justice. “There are no appeals in arbitrage,” says Lima. At the event in the Chamber, the attorney will warn those in attendance that on signing a contract, one must pay attention to certain aspects, lest it leads to an arbitration process. One aspect is increases in product prices. <\/p>\n According to the attorney with Mattos Filho, arbitration may be used by both legal and natural persons, provided that the issue at hand involves patrimonial assets. Arbitrage is common in cases of purchase and sale of companies, equity holdings, and others. In international contracts, arbitrage is also chosen for problem-solving. Upon signing the contract, the parties can decide which law they will observe, the language to be spoken, and where the negotiation will take place.<\/p>\n The attorney Flávio Pereira Lima has worked in arbitration for over 20 years now. His address, titled “Arbitration: Advantages and disadvantages compared with law suits,” is part of the Arab Brazilian Chamber Lecture Cycle.
