Brasília – The Federal Official Gazette published this Thursday (13) a normative instruction that cuts to zero the tax rate applied to payments sent abroad for the leasing of foreign aircraft by regular scheduled air services companies, of both passenger and cargo.
According to the Federal Revenue Service, among other rules, should be noticed the one that establishes that “until 2020 the tax rate was cut to zero, including in the cases of being directed to low-tax countries”. One of these countries is Ireland, where the majority of the contracts are signed.
The decision meets the demand of the sector after the government included Ireland in the lox-tax countries list. The measure could impact prices if leasing contracts made by airlines and signed in the country, since they would be taxed in 25%, which would increase costs and, as a result, increase fares. With the new normative instruction, these contracts remain with a zero rate.
The list of lox-tax countries was updated by the Federal Revenue Services in September and, besides Ireland, includes Austria, Curacao and Saint Martin.
