São Paulo – The Arab Brazilian Chamber of Commerce will promote the lecture “Islamic Law and International Right,” with layers Rabih Nasser and Salem Nasser, at 9:00 am on October 6. Enrolment is open.
Rabih and Salem are partners in a law firm that operates in the trade and international investment fields, business consulting, international law, and arbitrage. Both are professors at the Law School of the Getúlio Vargas foundation in São Paulo (FGV). Salem is also a member of the Committee on International Law of the International Law Association, based in London, United Kingdom.
Aside from being partners, the two are cousins. Although he is a descendent of Lebanese, Rabih claims that his origin had no influence on the choice of his line of work. He has devised contracts between Brazilian and Arab companies based in countries such as Jordan, Iraq, Saudi Arabia, Libya and Lebanon.
“In many Arab countries, the legal system is influenced by religion,” says Rabih. “These rules end up influencing companies’ business dealings. Thus, Brazilian companies may need to adapt products and contracts to abide to these countries’ rules,” the specialist adds.
He claims that the influence of religion in the legal system varies from country to country. “This influence may affect everything that concerns the financing system, such as the funding of foreign trade operations and payment conditions. These issues are relevant to all sectors,” he says.
The talk will also approach contract drafts, which may be elaborated by either the Brazilian or the foreign party. “There are a variety of rules that may apply to a contract, ranging from international law to domestic law in each country,” says Rabih. The event will also discuss safe contracts, and execution for breach of obligations, among other topics.
